Rental Agreement

  1. Renters must be 18 years or older.
     

  2. Rental equipment reservations can be made online 24 hours a day or by phone during Topsail Sunsational Rentals business hours.
     

  3. Reservations are on a first come, first served basis.
     

  4. Payment of the total rental fee is required at the time of reservation. Renters will be required to provide their credit card number, expiration date, and CVV code at the time of reservation and rental. By providing the credit card number information and reserving and/or taking the equipment, renters authorize Topsail Sunsational Rentals to charge any fees, and other amounts due from the reservation and/or rental of the equipment.
     

  5. There will be NO REFUND for reservations cancelled with less than 72 hours notice.  Renters will receive a refund less a $25 cancellation fee for all cancellations with 72 or more hours notice.   Cancellations must be made by telephone, email or in writing during Topsail Sunsational Rentals business hours.  Renters cannot cancel a reservation by leaving phone messages during non-business hours.
     

  6. If for some reason Topsail Sunsational Rentals cannot provide equipment  reserved by the renter, the renter will receive a full refund of the fees paid.  Topsail Sunsational Rentals shall have no further liability for failure to provide equipment on the reserved date.
     

  7. Refunds will be issued only to the person reserving the equipment and will be credited back to the credit card that charges originated on.  There are no cash refunds. 
     

  8. Reserved equipment not issued on the reserved rental date, due to tenant request, will be re-rented on a first come, first serve basis on the following day. There is no refund for reserved equipment or linens, refused by the tenant, unless same is re-rented to another customer.  There will be no refund for unused linens.

  9. No rain checks will be issued EXCEPT in the event of a MANDATORY Hurricane Evacuation.
     

  10. Renters must test all equipment  to ensure that everything is in working order. It is the renter's responsibility to check all equipment for damage or missing parts within 24 hours of delivery.

  11. Baby cribs are not assembled by our staff.  They do not require tools for assembly and directions are on the mattress board.  Cribs are delivered just inside of the entry door of rental unit or on a secure covered porch.  Cribs must be disassembled upon departure & placed back in the delivery location.  Failure to do so will result in a $10 service fee per crib.

  12. Renters must properly clean, dry, and pack the rental equipment prior to its return.   Linens do not have to be laundered, just placed back in the tubs received in. HOWEVER, we respectfully request that you do not place wet towels & cloths in the container, please make sure they are dry prior to placing them in the container.   If a renter returns equipment that is not clean, dry, or disassembled properly, a $10.00 service fee will be charged to the renter's credit card.  Remember to place all rental items back in the same location received in for pickup.
     

  13. If renters do not have items available by the scheduled return date and time, they will be charged a daily rental fee for each item, each day until the equipment is returned . In addition to scheduled pickups, resulting in a delivery truck having to return to premises, will result in a $15 service fee charged to your credit card.
     

  14. Renters will pay to replace equipment at its current retail value (a) if the equipment is returned to a location/premises other than delivery location and it is damaged, lost, or stolen; (b) the equipment is damaged, lost, or stolen while in the renter's possession.
     

  15. Topsail Sunsational Rentals reserves the right to inspect the equipment for up to 48 hours after its return and to charge the renter's credit card for any improper cleaning, drying, packing, or missing parts or damage found at that time. Notice of the charges will be sent to the renter by mail at the address noted on the contract.
     

  16. Topsail Sunsational Rentals reserves the right to refuse to rent equipment to renters in the future if they abuse equipment or violate the terms of these policies or the rental contract.
     

  17. All equipment shall be removed from beach and placed in a secure location at the end of each rental day.  Failure to do so will result in damaged or stolen equipment; thus a replacement cost charged to your credit card.  Umbrellas shall not be raised during extreme windy days due to the possibility of being blown over causing the arms to break or causing them to "lift" and snap.  You are requested to use your best judgment on such days to avoid replacement cost.

  18. Hurricane Policy:  In the event of a Mandatory Hurricane Evacuation, please call us at 328-6088 to arrange for your return and/or pickup of items rented. A "raincheck" will be issued in the prorated amount of unused days for your equipment, beginning with the date of mandatory evacuation IF prior to Wednesday of the week; otherwise, no refund.  No refund or raincheck shall be issued for "normal" inclement/bad weather during your stay.

  19. Grilling is not permitted on wooden decks, inside screened porches, garages or carport areas.  Failure to comply with posted rules and regulations will result in local precinct fines and possible eviction from rental unit.  Grills must be cleaned and free of charcoal debris and ashes before returning or pickup occurs.  Failure to clean will result in a $10.00 cleaning fee charged to renter's credit card.  Grills are delivered to the streetside, ground level of all units.  Condominiums do not allow secondary grill rentals as they provide their own grilling stations.

  20. A $10 non-refundable delivery/processing fee is incurred on all orders 7 days per week .  Deliveries are made to the exterior (carport area) of rental units except for condominiums , which are often placed just inside the entry door, or on a secure covered porch area.

(A)    Topsail Sunsational Rentals will not be held liable in the event of injury or accidental death due to improper use or malfunction of rental equipment.  This   includes, but is not limited to:  grills, high chairs, cribs, beach chairs, umbrellas, rollaway beds, strollers, baby gates, bed rails, etc.  Rental rules and regulations are agreed to by selecting the "I Agree" button below.  Equipment instructions will be provided at time of equipment delivery.
